5.2 Custom Development
For custom development projects:
- Client owns the final deliverables upon full payment
- SMARTTT retains rights to reusable code components and frameworks
- Third-party software and licenses remain property of their respective owners
- Source code ownership will be specified in project agreements
6. Limitation of Liability
To the maximum extent permitted by law:
- SMARTTT shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount paid by the client for the specific service in question
- We do not guarantee uninterrupted or error-free service
- We are not responsible for data loss due to client actions or third-party services
7. Warranties and Disclaimers

We warrant that our services will be performed with reasonable skill and care in accordance with industry standards.

Except as expressly stated:
- Services are provided "as is" without warranties of any kind
- We do not warrant that services will meet all client requirements
- We do not guarantee specific business results or outcomes

8. Client Responsibilities
Clients agree to:
- Provide timely access to necessary systems, data, and resources
- Provide accurate and complete information
- Maintain backups of critical data
- Review and approve deliverables within agreed timeframes
- Comply with all applicable laws and regulations
- Not use our services for illegal or unauthorized purposes
9. Confidentiality
Both parties agree to:
- Keep confidential information disclosed during the course of services private
- Use confidential information only for the purposes of the engagement
- Return or destroy confidential information upon request
- Maintain confidentiality even after termination of services
10. Support and Maintenance
Support and maintenance services:
- Are subject to separate agreements and fees
- Include response times as specified in service level agreements
- May be limited to business hours unless emergency support is contracted
- Do not cover issues caused by unauthorized modifications or third-party actions
11. Termination
Either party may terminate services by providing written notice as specified in the service agreement. Upon termination:
- Client must pay for all services rendered up to the termination date
- SMARTTT will deliver all completed work
- Both parties must return confidential information
- Provisions regarding confidentiality and intellectual property survive termination
12. Governing Law
These Terms of Service are governed by the laws of the Sultanate of Oman. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Oman.
13. Changes to Terms
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes constitutes acceptance of the modified terms.
14. Entire Agreement
These Terms of Service, together with any specific service agreements, constitute the entire agreement between you and SMARTTT regarding the use of our services.
